2009 Military Spouse of the Year Nomination Sweepstakes Official Rules-10/1/08-10/8/08
1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES
2. Eligibility: Sweepstakes begins October 1, 2008 at 10:10:00 a.m. Eastern Time (ET) and ends October 8, 2008 at 11:59:59 p.m. ET. Participation open to legal residents of the United States, age 18 or over and who are of legal age of majority in their jurisdiction of residence. Sweepstakes is offered only in the United States and is void in Alaska, Hawaii, Louisiana, Puerto Rico and where prohibited. Employees and Agents (and their respective family members: spouses, children, siblings, in–laws) of Victory Media, Inc., its affiliates, officers, directors, agents, employees, subsidiaries and service agencies [or independent contractors] are ineligible to participate or win a prize. A PURCHASE DOES NOT INCREASE ONE'S CHANCE OF WINNING.
3. To Enter: Participants may enter October 1, 2008 at 10:10:00 a.m. Eastern Time (ET) and ends October 8, 2008 at 11:59:59 p.m. ET. There are two ways to enter:
(a)Customers who nominate someone to be the 2009 Military Spouse of the Year on msoy.milspouse.com during the Sweepstakes Period will be entered for the drawing.
(b) Alternate Entry: No Purchase Necessary. Legibly hand print on a 3" x 5" postcard, your complete name, street address (no P.O. Boxes please), including city, state and zip code, daytime phone number (including area code) age and e–mail address (if available) and mail to: 2009 Military Spouse of the Year Nomination Sweepstakes, P.O. Box 26, Sewickley, PA 15143. All mail–in entries must be postmarked by October 8, 2008 and received no later than October 15, 2008. Each postcard entry must be mailed separately. No mechanical reproductions or facsimiles of postcard entries will be accepted.
Limit one entry per household, regardless of method of entry. Only complete entry forms are eligible. In case of dispute as to identity of an online entrant, entry will be declared made by the authorized account holder of the E–mail address used to enter the Sweepstakes at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned an E–mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational, institution, etc.) responsible for assigning E–mail addresses or the domain associated with the submitted E–mail address. Any other attempted form of entry is prohibited; automatic, programmed, robotic or similar means of entry are not permitted. Sponsor and its promotion and advertising agencies are not responsible for lost, late, damaged, incomplete, illegible, misdirected or postage due entries/mail or for technical errors of any kind including computer/information network failures, hardware, software, telephone or other communications malfunctions of any nature, errors or failures of any kind, lost or unavailable telephone or network connections, Website, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit a participant's ability to take part in the Sweepstakes. All entries become the sole property of the Sponsor and will not be acknowledged or returned. CAUTION: Any attempt by an entrant to deliberately damage any website or undermine the legitimate operations of the Sweepstakes is a violation of the criminal and civil laws. Should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law and disqualify such entrant from the Sweepstakes.
4. Drawing: The drawing will consist of all eligible entries received (see Section 3 "To Enter", above). The drawing will be conducted by Victory Media on or about October 16, 2008. Odds of winning depend on the total number of eligible entries received for the drawing. Judges' decisions will be final and binding in all matters relating to the Sweepstakes. Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend this Sweepstakes in whole or in part for any reason in its sole discretion including, without limitation, to change the sweepstakes rules or prizes in any jurisdiction or if causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor will select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor or from mail–in entries only. By entering Sweepstakes, entrants agree to be bound by these official rules and the decisions of the judges.
5. Prize: Three (3) prizes for the drawing: 1GB Apple iPod shuffle. The prize awarded in connection with the Sweepstakes is nontransferable and non–endorsable. The prize (or any portion thereof) cannot be transferred. No prize substitutions allowed, except at Sponsor's sole discretion in the event of prize unavailability for any reason, and then only for a prize of equal or greater value. All federal, state and local laws and regulations apply.
6. Notification: Each prize winner will be notified by phone and/or e–mail. If winner cannot be contacted, if prize is returned as undeliverable, or in the event of noncompliance with these Official Rules, the prize will be forfeited and an alternate winner will be selected. Upon forfeiture, no compensation will be given. Prize will be awarded to winner or an alternate winner under all circumstances.
7. Publicity: Except where prohibited, participation in the sweepstakes constitutes winner’s consent to Victory Media, Inc.’s use of the winner’s name, likeness, voice, opinions, hometown and state for promotional purposes in any media without further payment or consideration.
8. Conditions: All taxes are the sole responsibility of the winner accepting the prize. A 1099MISC Federal tax form will be issued to the winner for the value of the prize. Participation in Sweepstakes and acceptance of prize constitutes winner's permission to use his/her name, address (city and state only), likeness and any statements made by winner and/or company regarding the Sweepstakes or Sponsor for advertising and promotional purposes without additional compensation, except where prohibited by law. By acceptance and use of prize, winner agrees to hold harmless and indemnify Sponsor and its parent organization, affiliates, officers, directors, agents, employees, subsidiaries and service agencies [or independent contractors] against any and all liability, damages or causes of action (however named or described), with respect to or arising out of entrant's participation in the Sweepstakes, or the receipt or use/misuse of the prizes awarded herein. These parties, their respective affiliates and subsidiaries, advertising/promotional agencies, and each of their directors, officers, employees, agents, successors and assigns have no liability or responsibility for any personal injuries, losses or damages or claims of any kind resulting from participation in the Sweepstakes, acceptance, possession or use/misuse of any prize. Entrants who do not comply with the Official Rules or attempt to interfere with this Sweepstakes in any way shall be disqualified. There is no purchase or sales presentation necessary to participate.
9. Additional Terms: Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or Web site. For details regarding collection of information from users of the Web site (including entrants), please consult the privacy policy on the Web site. Additionally, Sponsor reserves the right to prosecute any fraudulent activities to the full extent of the law.
10. Winners List: For the name of the prize winner, send a self–addressed stamped envelope to: 2008 MilSpouse.com Social Networking Survey Sweepstakes Winners List, P.O. Box 26, Sewickley, PA 15143. Residents of VT may omit return postage.
11. Data Collection: Victory Media, Inc. collects personal information from you when you enter the Sweepstakes. The information collected is subject to the MilSpouse.com Privacy Policy, located at http://www.milspouse.com/privacy-policy-terms-of-use.aspx
12. This Sweepstakes is sponsored by Victory Media, Inc., 429 Mill St. Coraopolis, PA 15108.
13. The laws of the Commonwealth of Pennsylvania shall govern this Sweepstakes. Sponsor and participants agree and do hereby consent to jurisdiction of any court of the Commonwealth of Pennsylvania which has statewide jurisdiction with respect to any proceeding arising out of or relating to this Sweepstakes or its subject matter, and further agree that the mailing by registered mail of any process to the last known address of either party shall constitute lawful and valid service of process thereof. In the event any such suit is filed in any state or federal court in the Commonwealth of Pennsylvania, Sponsor and participants shall not raise and hereby waive the defenses of lack of personal jurisdiction or venue. In the event that such process requires an answer or response thereto, the time in which Sponsor and participants must file and serve such answer or response shall be computed from the day of its or her receipt of such process.
